if the liability is accepted by an insurance company, that company shall also be paying the total of legal costs related to your case (as far as the costs remain reasonable and in accordance with the prices customary in similar cases). This means, you would not need to pay any extra lawyers fee at all from your own pocket.
If the liability has not been accepted by any party and if your earnings is below the limit stipulated by the government, you will qualify for a legal supplement (in Dutch: toevoeging). This means that, in such a case you will only need to pay a small amount under the naming “own contribution” (in Dutch: eigen bijdrage). The rest of the legal expenses will be paid by the government. Depending on your financial situation, the minimum “own contribution” is stipulated at 90,- Euro.
If the liability has not been accepted by any party and if your earnings is above the limit stipulated by the government, you will receive an estimate of the legal costs specific to your case after the first appointment at our office.
If you have a legal aid insurance, you have the right to chose your own lawyer. With other words, you are not restricted to the lawyers or jurists that your insurance company assign or provide. Moreover, if the liability is already accepted by the insurance company of the counter party, you would not need to appeal to your legal aid insurance at all.
